11th Circuit Rules Individual Health Insurance Mandate Unconstitutional

In a good news-bad news scenario for lawyers challenging the individual mandate provision of Obamacare, the 11th circuit court in Atlanta ruled the provision unconstitutional by a 2-1 margain, while the 9th circuit court in San Francisco dismissed the case for lack of standing, even though it agreed to hear the case.

In the 11th, the judges ruled that the individual mandate was unconstitutional because it represented a broad interpretation of the Commerce Clause of the Constitution, which is the clause that gives Congress the power to keep commerce regular. The individual mandate, though, is an "unbounded assertion of congressional authority" inconsistent with that clause, which would require individuals to purchase health insurance for fear of penalty. The two judges that ruled in the majority were Judge Joel Dubina, a George H.W. Bush appointee, and Judge Frank Hull, a Bill Clinton appointee.

The 9th circuit, however, was a different matter entirely. The case was dismissed due to "lack of standing" on the part of the prosecutors, with Judge Dana Sabraw handing down the decision. This came after the case was turned down by the Supreme Court for expediated judgement. This ruling was not a shock to many people due to the left-leaning nature of this branch, which has often been called the "Nutty Ninth" for those reasons.

So far, three branches of the US Court of Appeals have ruled on the individual mandate, and only the 11th ruled it unconstitutional thus far. The third branch, the 6th up in Ohio, upheld it by a 2-1 vote, which would all but ensure that the fate of the individual mandate will not be decided until it reaches the Supreme Court once it is done working its way through the lower courts.

Individual Rights: the Price of the So-Called 'Affordable Health Care Act'

While investigating the provisions in the "affordable health care" bill that will inevitably force me, and millions of others like myself who choose not to purchase health insurance, I recently asked a friend who is an Obama supporter about the bill's details. He referred me to healthcare.gov, which contained much useful and insightful information, including the fact that getting 8 hours of sleep a night is actually a healthy thing to do, and that hospitals and clinics are actually places that people can go to get immunizations, prescriptions and primary care. It seems that the writer of this website was an obvious graduate of DUH University.

Recently however, there have many court cases challenging the Obama administration's abuse of the commerce clause in the Constitution. These court cases challenge the Obama administration's use of the commerce clause to force individuals into purchasing health insurance as well as each individual state's right to oppose the federal legislation.

"Medicare, Metapod, Medicaid...": Pokemon/Obamacare Interview

This video is great:  What appear to be a couple high school students interview people about Obamacare, while slowly working more and more Pokemon references into their conversations.  Almost everyone they speak with on both sides of the issue is so set in their opinions and uninformed about the actual policy that they completely miss the Pokemon references.  Definitely worth a watch -- and possibly imitating as an easy activism idea for your YAL chapter.

Obamacare Will Implicitly Tax the Middle Class

Apropos to the looming tax day, Sheldon Richman discusses the tax implications of Obamacare:

Now that President Obama’s health-insurance overhaul has become law, we can brace ourselves for the new taxes. What new taxes? Aren’t they only on the “rich” and on large companies?....

[T]hose are not the taxes I am not referring to when I say we should brace ourselves. The taxes I mean are the implicit taxes that ObamaCare will impose on most productive people. What’s an implicit tax?....

ObamaCare will tax much of the middle class. Under the new law, everyone everyone will have to buy government-defined medical coverage or have it bought for him by his employer, reducing cash wages. Thus, anyone who would not have bought insurance or would have bought a less-expensive policy will pay an implicit tax.

Tax Day Ideas: Post Office

This activism idea for Tax Day is an obvious one, yet really effective. There is no place on April 15th where you will find more people sympathetic to your cause than at your local post office (Tea Party events being an obvious exception). The post office is full of irritated, last-second tax payers and is a hot spot for local news.  

  • Before you hold the event, send a press advisory to your local news outlets.  If you write the release, CampusReform.org will send it out for you for free to a complete media list for your area.
  • Canvass the area with anti-tax and YAL signs -- "Taking your money is bipartisan," for instance.
  • Hand out fliers about taxes and what your YAL group is about.
  • Get community members' contact info by using the YAL petition to repeal ObamaCare.
