Florida judge correctly orders use of Islamic sharia law

It's enough to haunt the nightmares of any neoconservative worth his salt -- a judge in America is applying Islamic law in the courtroom!!  However, this summary, which is all that most opposors of the judge's actions say on the subject, is crucially inaccurate.  The St. Petersburg Times reports:

...Hillsborough Circuit Judge Richard Nielsen is being attacked by conservative bloggers after he ruled in a lawsuit March 3 that, to resolve one crucial issue in the case, he will consult a different source.

"This case," the judge wrote, "will proceed under Ecclesiastical Islamic Law." Nielsen said he will decide in a lawsuit against a local mosque, the Islamic Education Center of Tampa, whether the parties in the litigation properly followed the teachings of the Koran in obtaining an arbitration decision from an Islamic scholar.

If you haven't yet heard people frantically yelling about how this is an example of Muslims taking over our culture, you soon will.  For example, two Republicans in Florida are already on the move.  So, for when you encounter such people, let me explain a few things.

The Commercial Heritage and Contribution of Islam

I found this interesting lecture from the Mises Institute discussing some of the capitalist elements of Islam and the Muslim world. Although I don't 100% agree with what the speaker Mustafa Akyol says, this video is still informative and educational.

Playing Devil's Advocate: What's your solution?

I'm sure that many of you who also read Lew Rockwell.com have seen the recent blog post about David Horowitz. For those who don't have the stomach to get through the tripe that Horowitz has spewed onto his website let me give you a break down:  Muslisms = Bad, Israel = Good, Ron Paul = Crazy Jew Hater. I think that pretty much sums up Mr. Horowitz's arguments, though certainly feel free to elaborate in the comments here if you're so inclined.

But I'm not here today to take on David Horowitz; his craziness speaks for itself. What I'm here today to ask is, "Okay, only for the sake of argument, let's say you're right (though you're not).  What are your solutions?"

Of course, this question can be asked to any of the neocon chickenhawks who believe that Islam is inherently evil, that it is a political system and not a religion, and that its sole purpose is to take over the world and establish a global caliphate. Many of these people will drone on and on about how they stone women to death, that they might be planning a new holocaust, and mainly that they just want to kill everyone who isn't Muslim. However there is very few who will actually tell you how we stop the supposed "Muslim Menace."  So let's take a journey down their twisted logic and see where it ends up.

Have the terrorists won?

As many of you know, groups like Family Research Council, Concerned Women For America, American Values, the American Principles Project, the Capital Research Center, and others are boycotting this year's CPAC event because of the inclusion of GOProud as a partcipant.

But now CPAC is catching criticism for a new reason -- Muslims.  That's right -- the convenient catch-all boogeyman of radical Islam, eager to institute Sharia Law in America and get every woman into a spacesuit, has apparently taken over CPAC.  The terrorists, it seems, have won.  Raw Story reports:

The conservative columnist Frank Gaffney also criticized CPAC for inviting Americans for Tax Reform president Grover Norquist and former Bush staffer Suhail Khan, claiming the two men were part of a Muslim conspiracy to infiltrate the conservative community.

Breyer: Koran Burning Not a Settled Right

Here is Supreme Court Justice Stephen Breyer recently hinting that burning a Koran may not actually be a form of protected expression:

I've posted a lengthier criticism of this on my personal blog here.

France passes law banning voluntary religious practice.

The French senate approved Tuesday a law banning any veils that cover the face -- including the burqa, the full-body covering worn by some Muslim women -- making France the first European country to plan such a measure.

The law passed by a vote of 246 to 1, with about 100 abstentions coming essentially from left-leaning politicians.

..."Given the damage it produces on those rules which allow the life in community, ensure the dignity of the person and equality between sexes, this practice, even if it is voluntary, cannot be tolerated in any public place," the French government said when it sent the measure to parliament in May.

The law imposes a fine of 150 euros ($190) and/or a citizenship course as punishment for wearing a face-covering veil. Forcing a woman to wear a niqab or a burqa will be punishable by a year in prison or a 15,000-euro ($19,000) fine, the government said, calling it "a new form of enslavement that the republic cannot accept on its soil."

A Lesson in Inconsistency

Ground Zero Mosque

Quick disclaimer -- I'm not accusing all conservatives of abandoning the principle of private property rights when it isn't convenient to uphold the principle, nor am I accusing all of them of opposing Park51.  I'm only accusing the few individuals who actually oppose the construction of Park51.

'Ground Zero Mosque' Opposition about Freedom of Religion or Not?

In the ongoing debate over the proposed "Ground Zero Mosque," those opposing it have often claimed that they are not arguing that government should have the ability to stop the construction of the site. They say that the other side's constant criticism that the opposition to the mosque represents an attempt at restricting freedom of religion is false, because they are not advocating using government force -- only persuasion -- to prevent the construction.

But then came recent comments last week from one of the most vocal critics of the proposed construction, former Speaker of the House Newt Gingrich:

In a radio interview today, he said he wants the national government to step in and stop the developers from building the Islamic community center by whatever means necessary ... And if that fails, he said, the state government should step in and use its considerable power to stymie the development. "The Attorney General of New York, Andrew Cuomo, could intervene because frankly he has the ability to slow it down for decades if he wants to."

Government preventing the construction of a place of worship based primarily on the fact that a large group of citizens oppose that religion has no place under our system of government. It is becoming evident that several in the opposition to this construction are willing to use government force to prevent it. So much for that whole, "This is not about freedom of religion" thing.

Ron Paul on the Proposed Quran Burning

Hat tip to Lew Rockwell.  Ron Paul says:

A professed Christian pastor in Gainesville, Florida, Terry Jones, plans to burn copies of the Quran on 9/11. He indicts all Islam for 9/11 and argues that it is a hate-driven religion. He's convinced he's on God's side, even though he is getting little support from other Christians, who believe that Jesus is the Prince of Peace.

General David Petraeus, our military commander in Afghanistan, strongly condemned Mr. Jones' plan, arguing it would be provocative, make his fight against the Taliban in Afghanistan more difficult, and further jeopardize the lives of American soldiers.

I agree! To blame of all Muslims for the atrocities of 9/11 only makes things worse - especially since it wasn't the Taliban of Afghanistan that committed the atrocities on 9/11. Under Jones' warped logic, we should have attacked Saudi Arabia, since 15 of the 19 suicide bombers came from that country.
